1. Acceptance of Terms

By creating an account or using AutoDialler ("the Platform", "we", "us"), you ("the Customer", "you") agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

AutoDialler is a B2B SaaS platform that provides outbound voice campaign tools. We do not initiate calls ourselves — all calls are initiated by you, the Customer, using our software.

2. Permitted Use

You may only use AutoDialler to contact individuals who have given prior express consent to receive calls from you or your organisation. You are solely responsible for:

• Ensuring you have lawful consent to contact every number in your contact lists
• Complying with all applicable laws including UK PECR, GDPR, the Communications Act 2003, and any equivalent legislation in jurisdictions you operate in
• Complying with Ofcom guidelines and the Telephone Preference Service (TPS) in the UK
• Ensuring your audio messages are accurate, not misleading, and include appropriate identification
• Honouring all opt-out requests immediately and permanently

3. Prohibited Use

You must NOT use AutoDialler to:

• Contact individuals who have not consented to receive calls from you
• Call numbers registered with the Telephone Preference Service (TPS) without prior written consent
• Send spam, unsolicited marketing, or nuisance calls
• Impersonate any person, company, or organisation
• Conduct any form of fraud, scam, or deceptive practice
• Harass, threaten, or abuse any individual
• Violate any applicable law or regulation
• Resell or sublicense access to the Platform without written permission
• Attempt to reverse engineer, hack, or disrupt the Platform

4. Contact List Compliance

You warrant that all contact lists uploaded to AutoDialler have been obtained lawfully and that every contact has provided valid, documented consent to receive automated calls from you. AutoDialler does not verify your contact lists and accepts no liability for unlawful contacts.

5. Credits & Payments

AutoDialler operates on a credit-based system. Credits are purchased in advance and deducted per outbound call. Credits are non-refundable once purchased except where required by law.

Weekly subscription fees are non-refundable once the subscription period has commenced. All payments are processed via NOWPayments in cryptocurrency.

6. Account Suspension & Termination

AutoDialler reserves the right to suspend or terminate your account immediately and without notice if we reasonably believe you are in breach of these Terms, applicable law, or our telephony provider's acceptable use policies.

7. Limitation of Liability

AutoDialler provides the Platform on an "as is" basis. We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Platform, including any fines, penalties, or legal action resulting from your calling activity. Our total liability shall not exceed the amount you paid to us in the 30 days prior to the claim.

8. Indemnification

You agree to indemnify and hold harmless AutoDialler, its owners, and affiliates from any claims, damages, fines, or legal costs arising from your use of the Platform, including any breach of these Terms or applicable law.

9. Data & Privacy

AutoDialler stores account information and call logs necessary to operate the Platform. We do not sell your data to third parties. You are the data controller for all contact data you upload. AutoDialler acts as a data processor on your behalf.

10. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
